These Terms of Use (“Terms”) govern your access to and use of our Fundy platform (the “Platform” or “Fundy”). By creating an account or using Fundy, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use Fundy.
The Platform provides digital tools that assist users in analysing, constructing, researching and optimising investment portfolios.
We do not provide personalized investment advice, discretionary asset management, or any recommendation tailored to your personal financial situation. You remain solely responsible for your investment decisions and for verifying whether any portfolio or strategy is suitable for you.
Any portfolio outputs, optimisations, or insights generated by the Platform are provided for general informational purposes only and should not be interpreted as tailored investment recommendations. You remain solely responsible for all investment decisions made through or based on the Platform.
The information and analyses contained on this website may not be suitable for your specific circumstances. Legal, accounting and tax restrictions, transaction costs and changes to any assumptions may significantly affect the economics of any transaction. Accordingly, you should consult your own tax, legal, investment or other advisors, at both the outset of any transaction and on an ongoing basis, to determine such suitability.
Past returns are no indication or guarantee of future performance. The Platform does not guarantee any future performance. The value of invested capital and its revenues are subject to fluctuations that might lead to losses and the invested capital may even be reduced to zero. Moreover, investments in foreign currencies are also subject to exchange-rate fluctuations.

You must keep your login credentials confidential and are solely responsible for all activities under your account. You must note of the fact that you are required to disconnect from the identification services proposed by the Platform before leaving your Internet station.

You may use Fundy only for lawful purposes and in accordance with these Terms.

We may modify, suspend, or discontinue any part of the Platform at any time.
All content, software, algorithms, research outputs, data models, optimization engines, graph-analysis tools, trademarks, and other materials available on or generated by the Platform are the exclusive property of AtonRâ Partners SA or its licensors.
Unless expressly authorised in writing by AtonRâ Partners SA, you receive only a limited, non-exclusive, non-transferable and revocable licence to access and use Fundy for its intended purposes.
Commercial use of the Platform (such as providing services to clients, using Fundy within a professional advisory business, or integrating Fundy into another product) is permitted only if you hold a valid commercial agreement, enterprise licence, or a contract with AtonRâ Partners SA. Any commercial use outside such agreements is strictly prohibited.
Nothing on the Platform constitutes:
Any portfolio illustrations, analytics, or simulations are for informational purposes only and may not reflect actual market conditions.
All of the investment decisions you take shall be based exclusively on your own assessment of your financial situation and your investment goals, as well as on your own personal interpretation of the information available, in particular technical analyses published on the Platform, transmitted to you or obtained via the tools proposed by the Platform. You are solely responsible for such decisions.
The Platform may integrate or link to third-party tools, content, or service providers (e.g., data feeds, brokers, custodians). We are not responsible for the content, accuracy, or availability of third-party services.
Your use of third-party services is at your own risk and may be subject to separate terms.
Our processing of personal data is governed by our Privacy Policy. By using the Platform, you agree to the processing of your data as described in the Privacy Policy.
The Platform is provided “as is” and “as available.”
We do not guarantee:

We, our directors, officers, employees, contractors, and affiliates, are not liable for any losses or damages arising from or in connection with your use of the Platform, including but not limited to:

You may close your account at any time by contacting us.
Certain obligations (including IP protection, liability limits, and disclaimers) continue after termination.
We may update these Terms from time to time. Updates will be posted on the Platform with a revised “last updated” date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
These Terms are governed by Swiss law, excluding conflict-of-law principles.
The sole place of jurisdiction for all disputes arising out of or in connection with the Terms and Conditions stipulated herein and/or the use of the website is Geneva, Switzerland. AtonRâ Partners SA nevertheless reserves the right to initiate proceedings against you before the competent court at your domicile or any other competent authority.
